As the Chief Minister of Penang, the position speaks for itself of its vast power. The power vested in that position wields such responsibility. LGE can delegate tasks, but the overall outcome remains with him as the task is accountable to him for the standard required from his governance through his officers.
Let’s look at the facts, everyone knows the issue revolving the Kg Buah Pala since 1999 yet, I repeat that the actual transfer was done on March 27, 2008, three weeks after LGE came into power. DAP media has been running strings of releases over the last couple of days to shield itself rather than being explicitly clear on its stance since Kg Buah Pala issue exploded with the involvement of HINDRAF.
It all started with the “stroke of a pen” statement issued by Uthayakumar when he suggested that the LGE could stop the eviction and regain the land for the residents. Now let’s look at some of the things LGE have been stating since then. Let’s talk first on the rule of law, this was the first thing he said, he had to respect the law and there is nothing can be done.
When social activists started getting involved and questioned on the power vested under the Land Acquisition Act 1960, it then move on to the cost in acquiring from few hundred millions to tens of millions and the fault of the previous administration. Now, of course it is absurd for the Penang state government to spend millions of ringgit to buy out from the developers of a yet developed land. Now this is questionable because, no development had taken place and furthermore there are provisions to challenge the developer’s claim for such instances under Land Acquisition Act 1960 that the state Legal team or even the DAP legal team who fought tooth and nail against the federal government for the vested power of the state in Perak for New Villages and Kg Tersusun issue could have advised him.
The previous “mambo jumbo” administration, yes we all know about it and that is why the public elected Pakatan to govern the state. Again, they sold it below market value to Koperasi Pegawai Kanan Kerajaan Pulau Pinang, but what did LGE’s legal team come up with to question the land transfer and the questionable circumstances surrounding the sale. Well, any lay person would know that if there is an element of fraud is involved even retrospectively, then such agreement can be invalidated. Hey!!! This is not my job, but for PAKATAN’s legal team and how much effort was put into it. (I think this is not so easy in BOLEH LAND)
Then the compensation issue, you say $200,000, but the residents claims that was only $90,000. Now who do we believe? The compensation is not even an issue for the residents as they are keener in preserving their ancestral home and what Pakatan government had done to retrieve it as promised prior to the election. Again question of accountability based on trust I presume.
If you notice, everything from the DAP came out in piecemeal manner as and when the public start to probe deeper into the affair. Well I can understand with BN, even if you disclose everything, nothing happens because that is the way we have accepted and dealt with it, but with PAKATAN we wanted to see the difference, yet it seems that DAP is slowly slipping into the same rut.
Yes, I agree PAKATAN is definitely doing a great job in Penang, but isn’t that why we had elected them for, but then why did Kg Buah Pala slip their sight although the issue has been there for sometime. Why is that LGE’s team slept through the Kg Buah Pala issue? You can say that they can’t please everyone, but this is not about pleasing someone but where was the accountability for these residents that the PAKATAN government eagerly promised that they will retrieve this land once they are in governance.
Why does the CM now need to come and defend his action with all these excuses when a lot more could have been done from day one, he took power. Where is his accountability? Why did he not pursue any action to invalidate what seems to be a questionable transaction? Are you telling me that they don’t have the right or the mechanism when the whole Malaysia knows that the state was short changed in the said transaction? Seriously I think Penang state government needs to revamp its legal department and bring in some serious practitioners who will be able to carry out their task for the socio development of the state.
There is a serious injustice done to the Kg Buah Pala due to the lack of accountability by the governing state government through the elected members for these residents. All said and done, it is still not too late for LGE to correct by putting his legal team to work on the legal technicalities that could prevent the demolition and prevent the payment of any large compensation rather than being adamant and playing truant by giving all kind of excuses.
Nobody is asking Pakatan led government to cow into demands but prove to us how accountable you have been in the Kampung Buah Pala issue rather than throwing rhetoric without addressing the root cause for the socio development cause like what BN use to do. I don’t think this is too much to ask. If LGE is unable to solve this problem or incapable, then he should move on and let someone from the Pakatan echelon to do this job to preserve the change that the voters voted for.
As for the public viewers, sometimes we get carried away and say things without a thought because we really don’t take the trouble to digest the message nor understand the crux of the matter but only interested in voicing what one think within a narrow line of black is black and white is white. Sometimes with worldly experience and exposure to humanity issues, for a just cause, the public maybe able to see that white can be black and black can be white as long as it is a just and fair cause addressing humanity issue to survive for its basic need.
